Linen2GO's Terms and Conditions for Consumers Regarding the Use of
1. Conclusion of the Contract – Scope of Application
1.1. These General Terms and Conditions (“GTC for Private Customers”) apply to the business relationship between SALESIANER Regio AG, Langenhagstrasse 13, CH - 4147 Aesch, VAT ID: CHE-170.518.231 (hereinafter referred to as“L2G”) and the customer (“User”) for all business relationships, in particular in connection with the ordering and self-service pickup of rental linens from a service box/shop/express (“pickup station”) The Terms and Conditions apply exclusively provided that the customer qualifies as a consumer within the meaning of Swiss consumer protection law.
2. General Provisions
2.1. To use L2G’s services and the pickup station via the app, users must register and create a user account (“User Account”). Acceptance of these Terms and Conditions for Private Customers and the Privacy Policy is a prerequisite for registration. This does not entitle the user to enter into a contract with L2G.
2.2. When registering, the user must provide accurate and genuine personal information. Additionally, a credit or debit card must be registered as a valid payment method during the registration process.
2.3. If the information provided changes after registration, the user is required to update it immediately.
2.4. Users must protect access to their user accounts from unauthorized third parties. If users suspect that their user account is being misused, they are required to notify L2G immediately.
2.5. L2G reserves the right to delete user accounts associated with incomplete registrations after a reasonable period of time. The same applies to user accounts that have not been used for an extended period (more than 12 months). L2G will notify the user before deleting such an account.
2.6. In connection with the use of the pickup station, L2G processes information about users, including personal data. This includes, in particular, information that users provide to L2G. Upon termination of the user agreement, the data provided by the respective user or generated through their use will be stored or deleted by L2G in accordance with legal obligations (as well as where there is a legitimate interest). Aggregated data generated through use (e.g., statistics) will generally continue to be retained even after the end of the agreement (see Privacy Policy).
3. Shared user accounts
3.1. Users have the option of sharing a registered user account with multiple users (“Shared User Account”). Any user acting as an administrator (“Group Administrator”) may invite other users to use their user account.
3.2. Group administrators must set up a valid group payment method for all users of a group user account, which can be used to process payments for L2G services. Group administrators are responsible for all activities—in particular orders, contract conclusions, and payments—carried out by users of their group user account and will be notified of all such activities.
3.3. If an individual user account or the group user account is deleted, the group administrator will be billed for any outstanding orders or costs associated with current rental agreements.
3.4. Group administrators must delete any inactive users associated with the group account (due to users leaving the group or for other reasons).
4. Available quantities of rental linens, duration of use, return after the rental period expires
4.1. As a general rule, only quantities of up to 500 items of laundry are provided to consumers. Order quantities exceeding this limit are possible only by individual written agreement.
4.2. Please note that laundry may be removed from the pickup station no more than twice in a row without returning used laundry at the same time during that period. By the third pickup at the latest, used laundry equivalent to 33% of the items removed must be returned. Only then can clean laundry be removed from the pickup station again. This is intended to ensure the principle of laundry rental and an economical laundry cycle.
4.3. L2G makes every effort to ensure that L2G pickup stations are stocked with sufficient merchandise. L2G assumes no liability or guarantee that sufficient merchandise will be available for all users at all times.
4.4. The user is required to return all rental linens to L2G. The prices listed are flat rates that include service charges, cleaning costs, and rental fees, and are billed for a rental period of 16 days.
4.5. If the rented linens are not returned after the 16-day rental period has expired, L2G will charge a rental fee of CHF 1.59 per week or portion thereof for small items (cushion covers, hand towels, bath mats, shower towels) and CHF 2.90 for large items (duvet covers and fitted sheets). The rental fee will be charged to the user until the replacement cost of such a rental linen item has been fully covered.
5. Prices and Discounts/Price Adjustments – Payment Method – Late Payment
5.1. L2G reserves the right to change the prices of the items displayed on the website or the L2G app at any time and to correct any inadvertent pricing errors. Any price changes will not affect the prices of rental linens already picked up by the customer.
5.2. The prices listed on the website or in the L2G app are in CHF for all items and include applicable sales tax.
5.3. The user must pay a monthly service fee of CHF 10.03 for the use of the user account. This fee applies for each month in which the user actively uses the pickup station for at least one day by renting laundry items.
5.4. The only accepted payment methods are credit card or debit card
5.5. The user’s account or credit/debit card will be charged upon confirmation of the user’s pickup of the rental linens. L2G verifies the user’s provided information and creditworthiness, where warranted, by cross-checking data and/or submitting a query to an appropriate service provider. If the customer’s credit card or specified payment method cannot be charged or processed, the customer will be asked to provide a valid payment method. If no valid payment method is provided, the customer will not be able to remove any rental linens. The customer will be asked to immediately return all removed rental linens to the linen storage area.
5.6. If a user defaults on payment, L2G is entitled to charge late payment interest at a rate of 5% per annum.
6. Recording of additions
6.1. The user acknowledges and agrees that the pickup station is under video surveillance and that access is recorded. Further details regarding data processing can be found in the Privacy Policy.
7. Termination of the Agreement
7.1. If the user still has laundry items assigned to them at the time of termination, they must return them to L2G by the specified date, but no later than 16 days thereafter.
7.2. If the rental linens are not returned to L2G in full upon termination of the contract, L2G may charge the user for all rental linens still in the user’s possession at the then-current replacement cost.
8. Warranty for Defects
8.1. L2G makes textiles available for the user to pick up at the pickup station. The user must inspect the rented linens for defects before use. If the user discovers a defect (stains, damage) before use, they must return the defective rented linens unused to the pickup station within 16 days. All items subject to a complaint will be inspected by L2G, and if the complaint is justified, the rental fee will be credited toward the next pickup. If no complaint is made within 16 days, the goods are deemed to have been accepted by the customer as free of defects.
8.2. The user must use the rental linens with care and for their intended purpose. L2G reserves the right to charge the customer the replacement cost for rental linens that are excessively soiled or used for purposes other than those intended.
9. Liability for Damages
9.1. Within the scope specified above, L2G shall not be liable, in particular, for product-related information and recommendations provided free of charge, or for hyperlinks that refer to third-party websites.
9.2. The user must ensure that third parties do not have access to their login credentials; the user is liable for any unauthorized use of the pickup station that may result from this.
10. Retention of Title
10.1. L2G retains ownership of all rented linens.
10.2. The user is obligated to protect the rented linens from unauthorized use by third parties, particularly from damage or destruction.
11. Product Availability and Restrictions
11.1 The quantities and selection of rental linens offered may vary depending on seasonal availability or demand. L2G reserves the right to change the quantities and selection of rental linens at any time.
12. Severability Clause
12.1. If one or more provisions of these General Terms and Conditions for Private Customers are invalid, this shall not affect the validity of the remaining provisions. Invalid provisions shall be replaced by valid provisions that come as close as possible to the intended economic purpose.
13. Governing Law and Jurisdiction
13.1. Swiss substantive law shall apply. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.
14. Privacy Policy
14.1. L2G’s Privacy Policy provides a detailed description of how personal data is processed and what measures are taken to protect it. Personal data is processed for the purpose of managing the business relationship and is disclosed to third parties (such as payment service providers) exclusively for this purpose. The user is entitled to prohibit the transfer of data at any time. L2G stores the user data and sends it to the user via email together with these Terms and Conditions for Private Customers. The Terms and Conditions can be viewed at any time at www.linen2go.at. Order details can be viewed in the user account.
